This petition is filed to condone the delay of 760 days in filing the petition to set aside the abatement caused due to the death of the sole Appellant.

2. Heard both sides. This Court has perused the affidavit filed in support of this petition wherein it has been stated that the sole appellant viz., Kannan passed away on 24.06.2020 leaving behind his wife-Indra Candy, two sons- Boobalan and Gunasekaran and one daughter-Priyadharshini as his legal representatives.

3. Being satisfied with the reasons stated in the affidavit filed in support of this petition, the delay of 760 days is condoned and the petition is allowed.
