Writ petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus directing the third respondent herein to implement the order dated 23.09.2016 in C.No.498/2016/B1 passed by the first respondent within the time as stipulated by this Hon'ble Court.

O R D E R

This petition has been filed to directe the third respondent herein to implement the order dated 23.09.2016 in C.No.498/2016/B1 passed by the first respondent. 2.

The petitioner filed this petition to implement the order passed by the first respondent under Section 107 of Cr.P.C. The said order was passed in the month of September, 2016. The period for the proceedings under Section 107 of Cr.P.C. is only for one year. Now, almost three years have been lapsed and hence, the prayer sought for by the petitioner has become infructuous.

Accordingly, this writ petition is dismissed as infructuous. No costs. Consequently, connected miscellaneous petition is closed.
