Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the respondents to revise the pay scale of the petitioner from 5200+ 20200 + 2800 to 9300 + 34800 +4300 as per the G.O.Ms.No.234, Finance (Pay Cell) Department, dated 01.06.2009, considering the representation dated 07.01.2022 by the petitioner to the 2nd respondent and the representation dated 13.07.2022 by the 6th respondent to the 5th respondent, within a time frame as may be fixed by this Court.

ORDER

This writ petition has been filed for a Mandamus seeking for a direction to the respondents to revise the pay scale of the petitioner from 5200+ 20200 + 2800 to 9300 + 34800 +4300 as per the G.O.Ms.No.234, Finance (Pay Cell) Department, dated 01.06.2009, by considering the petitioner's representation dated 07.01.2022, within a time frame to be fixed by this Court.

2. The petitioner claims that after the Sixth Pay Commission, her salary and 2/4

other similarly placed persons were revised as stated supra. According to her, G.O.Ms.No.234, Finance (Pay Cell) Department, dated 01.06.2009 was also issued pursuant to the recommendations of the Sixth Pay Commission. The petitioner has given a representation dated 07.01.2022 to the 2nd respondent seeking for revision of her pay scale as per G.O.Ms.No.234 dated 01.06.2009. According to the petitioner, the 2nd respondent has also forwarded the petitioner's representation to the 5th respondent. However, till date, no final orders have been passed. No prejudice would be caused to the respondents, if the petitioner's representation is considered on merits and in accordance with law, within a time frame to be fixed by this Court.

For the foregoing reasons, this Court directs the 4th respondent to pass final orders on the petitioner's representation dated 07.01.2022 seeking for revision of her pay scale from 5200+ 20200 + 2800 to 9300 + 34800 +4300 as per the G.O.Ms.No.234, Finance (Pay Cell) Department, dated 01.06.2009, on merits and in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order.
