Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a writ of mandamus to direct the respondents to immediately rectify the revenue records and reinstate the petitioner name as the rightful owner of the property in Survey No.108/22, in question. ORDER

By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself.

2. The relief sought in this writ petition is to direct the respondents to immediately rectify the Revenue Records and reinstate the petitioner name as the rightful owner of the property comprised in Survey No.108/22 measuring an extent of 0.01.5 Ares situated at Madipakkam Village, Sholinganallur Taluk, Chennai District.

The learned Special Government Pleader appearing for the respondents submitted that the present writ petition is ought not to be entertained since the petitioner has preferred an Appeal dated 24.03.2025 under Section 10 of the Tamil Nadu Patta Pass Book Act, 1983 before the Revenue Divisional Officer, Tambaram West, Chennai - 600 045 and the same is pending.

4. The learned counsel for the petitioner submitted that it would be suffice that if the Revenue Divisional Officer, Tambaram West, Chennai - 2/5

600 045 is directed to dispose of the petitioner's Appeal dated 24.03.2025, within a time frame to be fixed by this Court.

5. The learned Special Government Pleader appearing for the respondents submitted that he has no objection to such direction being issued by this Court.

6. In view thereof, this Writ Petition stands disposed of on the following terms:

(i) The Revenue Divisional Officer, Tambaram West, Chennai - 600 045 is directed to dispose of the petitioner's Appeal dated 24.03.2025, if it is otherwise in order, after issuing notice and affording a reasonable opportunity of hearing to the petitioner and all other interested parties including rival claimants, if any, within a period of sixteen weeks from the date of uploading of the web copy of this order without waiting for the receipt of a certified copy of this order.

(ii) It is made clear that this Court has not expressed any views with regard to the merits of the case. The Revenue Divisional Officer, Tambaram West, Chennai - 600 045 shall independently consider the 3/5

matter on its own merits and in accordance with law including but not limited to the provisions of the Tamil Nadu Patta Pass Book Act, 1983 and Tamil Nadu Patta Pass Book Rules, 1987.

(iii) Rights and contentions of the petitioner and all other interested parties are left open. No costs.
