The petitioner, who was arrested and remanded to judicial custody on 21.06.2025, for the offence punishable under Sections 120B, 467, 408 and 409 of IPC in Crime No. 12 of 2024, registered on the file of the respondent, seek bail. 1/5

The case of the prosecution as per the defacto complainant, who is a Regional Collection Head of M/s.Shriram Finance Limited, Salem District is that the petitioner, who has been working as Branch Team Leader, Kolathur Branch in the abovesaid finance company, along with other accused persons joined together, fabricated the documents, forged the loan applications and cheated the finance company to the tune of Rs.1,11,20,000/- Hence, the case.
3. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He also submitted that the petitioner is in no way connected with the alleged offence, however, he is suffering incarceration from 21.06.2025. It is the contention of the petitioner that none of the customers lodged a complaint. It is his further contention that there was some dispute regarding non-completion of task and hence, a false case has been foisted against the petitioner. He also submits that co-accused/A4,A8,A9,A12 and A14 in this case were enlarged on anticipatory bail and A1 was arrested subsequently released on bail. He further submitted that the petitioner is ready to abide by any stringent condition that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner. 2/5

Learned Government Advocate (Crl.side) appearing for the respondent police, while opposing for grant of bail to the petitioner submitted that there are totally fourteen accused and the petitioner has been arrayed as A2. He submits that petitioner, who has been working in defacto complainant's finance company, collected particulars of closed loan accounts using which, they had processed new loan and they had made their account numbers in the loan applications and received money from the bank in the name of third parties. He also submits that totally a sum of Rs.1,11,20,000/- (rupees one crore eleven lalkhs twenty thousand only) has been misappropriated and a sum of Rs.81,95,000/- has been misappropriated by this petitioner. Hence, he opposed to grant bail to the petitioner.
5. Heard both sides and perused the materials available on record.
6. Considering the facts and circumstances of the case, nature of allegations, submissions made by the learned counsels on either side, it is seen that petitioner, arrayed as A2, was employed as Team Leader in M/s. Shriram 3/5
Finance Limited and had processed 16 loans without the knowledge of the loanees. Taking advantage of and having access to the earlier loan documents submitted by them which has already been discharged, the petitioner created further loans in their names and ensured that the loan amounts were disbursed to the account details given by him.. Thereby, the petitioner had misappropriated to the tune of Rs.81,95,000/- Taking note of the gravity of the offence and considering the fact that the petitioner had misappropriated huge sums of money, this Court is not inclined to grant bail to the petitioner.
