in WA Sr.No.37549 of 2018 S.MANIKUMAR, J., AND P.RAJAMANICKAM, J., [Order of the Court was made by S.MANIKUMAR, J.] Instant Writ Appeal in W.A.SR.No.37549 of 2018 is filed against the order dated 04.08.2014 made in W.P.No.20554 of 2014, by which, the Writ Court has set aside the order of District Educational Officer, the third appellant herein in Na.Ka.No.6896/A3/2013, dated 10.03.2014 and directed the appellants 1 to 3, to sanction incentive increments for acquiring M.Phil qualification, by extending the benefits of the G.O.Ms. Nos. 209 and 15 School Education Department dated 08.07.2010 and 28.03.213 respectively, issued by the Secretary to the Government School Education Department, Chennai.

2. Papers have been returned on 07.05.2018 for certain defects to be complied with. Thereafter, defects were complied with and represented on 04.09.2019, resulting in a delay of 475 days is representing. Reasons assigned are not satisfactory. However, based on the record of proceedings, Mr.K.Karthikeyan, learned Government Advocate submitted that similar appeal has already 1/3

been posted for final hearing on 03.10.2019, before a Hon'ble Division Bench.

In view of the above, we are inclined to condone the delay of 475 days in representing, subject to the condition that the petitioner/appellant, pays a sum of Rs.1,000/- (Rupees One Thousand Only), to the account of Juvenile Justice Fund, Director of Social Defence, Ministry of Social Welfare, Government of Tamilnadu, Kellys, Kilpauk, Chennai-600 010, within a period of two weeks from the date of receipt of the copy of this order. It is made clear that if costs is not paid, within the above said period, CMP.No.19467 of 2019 would stand dismissed, without any further reference to this Court.
