PETITION under Article 226 of The Constitution of India praying for the issuance of a Writ of Mandamus directing the respondent to dispose of the appeal of the petitioner dated 23.3.2015 expeditiously.

ORDER

Mr.S.Diwakar, learned Special Government Pleader takes notice for the respondent. Heard both. By consent, the writ petition itself is taken up for final disposal.

2. The petitioner challenged the order passed by the District Collector, Kanyakumari District dated 13.2.2015 imposing penalty for illicit quarrying and transportation of 5,950 units of rough stone, by filing an appeal before the respondent. In this writ petition, the petitioner seeks a direction to the respondent to dispose of the appeal.

3. The learned counsel for the petitioner would submit that the respondent entertained the appeal and fixed a personal hearing on 28.9.2015, which was subsequently adjourned to 26.10.2015 and on that date, the petitioner along with his counsel appeared before the respondent and argued the matter in great length. In spite of lapse of 11 months, no final orders have been passed.

In the light of the above factual position as pleaded by the petitioner, the writ petition is disposed of with a direction to the respondent to pass final orders on the appeal petition filed by the petitioner, within a period of four weeks from the date of receipt of a copy of this order and communicate the same by registered post to the petitioner.
