Civil Miscellaneous Appeal filed under Order XLIII Rule 1 (d) C.P.C. against the order and decreetal order dated 07.12.2021, made I.A.No.3 of 2021, in I.D.O.P.No.261 OF 2017 on the file of the Principal District Judge, Thiruvallur.

JUDGEMENT Today, when the Appeal is taken up, the learned counsel appearing for both the parties submitted that the matter has been settled between the parties before the Mediation Centre and as per the settlement arrived at between the parties, they have filed a Joint Memorandum of Compromise, dated 08.03.2024, which is duly signed by both the parties.

2. Thus, as per the Memo of Compromise, the appellant/wife herein agrees to receive a sum of Rs.2,00,000/- (Rupees Two Lakhs only) towards Sridhana Articles, and the said sum has also been handedover by the respondent/husband in cash directly to the learned counsel for the appellant/wife.

In view of the aforesaid Joint Memo of Compromise, dated 08.03.2024 filed by the parties (appellant/wife and respondent/husband), which is duly signed by them as well as their respective counsel, the marriage between the appellant/wife and the respondent/husband is dissolved on mutual consent and the payment made by the 2/4

respondent/husband of Rs.2,00,000/- towards Sridhana Article, which is received by Mr.R.Maran, the learned counsel on behalf of the appellant/wife is recorded.

Therefore, by reason of the compromise, the decree for divorce granted by the Court below in I.D.O.P.No.261 of 2017 is confirmed and the order of dismissal passed in Interlocutory Application, which was filed against the said decree is upheld and the present Civil Miscellaneous Appeal is disposed of as per the terms of the said Joint Memorandum of Compromise. The said Joint Memo of Compromise is taken on record and the same shall form part of the decree. No costs. 15.03.2024 sd To The Principal District Judge, Thiruvallur.
