Comp.A.No.579 of 2017 in M.SUNDAR.J., Learned Deputy Official Liquidator on behalf of applicant and Mr.M.Baskar, learned counsel for 'Tamil Nadu Housing Board' ('TNHB' for brevity) are before this Court.

2. Read this in conjunction with and in continuation of earlier orders made by Hon'ble predecessor Judge dated 21.02.2020, which reads as follows: 'The Official Liquidator has filed a report stating as follows: '4. That the Official Liquidator has approached Senior Advocate Shri.S.R.Sundar to file an appeal against the low quantum of compensation awarded by TNHB in connection with acquisition of the land under Land Acquisition Act. A letter in this regard was sent to the advocate on 13.02.2020 for which he has replied seeking brief facts of the case. In reply the Official Liquidator has forwarded e-mail dated 20.02.2020 along with documentary evidences in connection with landed property acquired by Government of Tamil Nadu Land Acquisition Act, to the advocate who has been appointed by this office to represent the Official Liquidator before this Hon'ble High Court.'

2. In view of the above, the Official Liquidator is finally given

time till 13.03.2020, failing which further orders will be passed. Post the matter on 13.03.2020.'

Today, a communication from the Special Tahsildar (Land Acquisition), who was incharge of the acquisition proceedings (to be noted TNHB is the acquisitioning body) being letter dated 27.02.2020 bearing reference Rc.No.6986/1999/F.3 has been placed before this Court and vide the said letter it has been mentioned that enhancement of compensation has to be sought only by resorting to Section 18 of Land Acquisition act, 1894. This application is closed preserving the rights of the Official Liquidator to seek enhancement of compensation under Section 18 of the Land Acquisition Act, 1894.
