Respondents Prayer:- Writ Petition filed under Article 226 of the Constitution of India, 1950, praying to issue a Writ of Mandamus, directing the Respondents herein to consider the application for Building Plan Approval vide PPA/WDCN08/03106/2022.

Heard Mr. Amrith Bhargav, Learned Counsel for the Petitioner and Mr. D.B.R.Prabhu, Learned Counsel, who takes notice for the Respondents, and perused the materials placed on record, apart from the pleadings of the parties.

It is the case of the Petitioner that he had made application no. PPA/WDCN08/03106/2022 dated 23.03.2022 for building permit to the Respondents, but as no action has been taken thereon, it has necessitated him to file this Writ Petition.

It has been brought to notice by Learned Counsel for the Respondents that as the Petitioner has not furnished the particulars sought in proceedings in W.D.C. No. PPA/WDCN08/03106/2022 dated 30.03.2022, it has been returned unapproved in proceedings in W.D.C. No. T.P. PPA/WDCN08/03106/2022 dated 16.04.2022 and their copies have been produced. In view of the same, Learned Counsel for the Petitioner seeks permission of this Court to withdraw the Writ Petition reserving the right of the Petitioner to work out his remedies before the proper forum in the manner recognized by law. He also made an 2/4

endorsement to that effect in the court record. 4.

In fine, the Writ Petition is disposed with the aforesaid clarifications. No costs.
