Respondents Prayer:- Writ Petition filed under Article 226 of the Constitution of India, 1950, praying to issue a Writ of Certiorarified Mandamus, calling for the records connected with the impugned order passed by the Third Respondent in his letter No. K/K: No. 40048/C/x/r (1)/2012 dated 08.01.2013 and quash the same and consequently direct the Fourth Respondent to refund the recovered amount, a sum of Rs. 1,77,362/- (Rupees one lakh seventy seven thousand three hundred and sixty two only) which was recovered from his retirement benefit of Death cum Retirement Gratuity along with interest.

The Writ Petition has been filed challenging the Letter in Mu. Muu. No. 40048/Vu.O.O.Sa(1)/2012 dated 08.01.2013 of the Third Respondent and to consequently direct the Fourth Respondent to refund the sum of Rs.1,77,362/- which was recovered from his retirement benefit, viz., death cum retirement gratuity, along with interest.

Learned Counsel for the Petitioner submits that by efflux of time, the relief sought in this Writ Petition does not remain for consideration, and he has made an endorsement to that effect in the court record.

In fine, the Writ Petition is dismissed as infructuous. No costs.
