This Original Petition has been filed taking advantage of Section 372 of the Indian Succession Act, 1925 along with relevant Rules of the Original Side of Madras High Court seeking Succession Certificate relating to the securities in the name of R.Sundaresan, who died intestate on 04.03.1983. The petitioner is the son of the deceased, the 1st respondent is his mother and the 2nd respondent is his sister. The learned counsel for the petitioner stated that the petitioner and the respondents were not aware of the details of the share certificates and when that came to their knowledge, they had filed the present original petition. The respondents have not raised any objection. 2.After following due procedure, the petitioner was directed to tender evidence. Accordingly, the petitioner examined himself as PW-1.
The death certificate and legal heirship certificate of his father were marked as Exs.P8 and P9. The documents relating to shares were marked as Exs.P1 to P7. 3.Taking into consideration the nature of evidence adduced and the documents produced, this Original Petition stands allowed. The Succession Certificate may be issued in favour of the petitioner in accordance with the rules.
