This Writ Miscellaneous Petition has been filed seeking recall of the order dated 01.09.2023 passed in W.P.No.26796 of 2012 by this Court.

2. Heard the learned counsel appearing on either side and perused the materials available on record.

3. The learned counsel for the petitioner submitted that, in view of the order passed by the Hon'ble Division Bench of this Court in W.A.No.650 of 2012, dated 27.09.2012, he is not pressing the writ petition.

4. In the light of the above submission, the order dated 01.09.2023 passed by this Court in W.P.26796 of 2012 is hereby recalled. Accordingly, this Writ Miscellaneous Petition is ordered and the Writ Petition is dismissed as withdrawn.
