The petitioner, who is arrayed as A2, apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 6(4) of TNSC (RDCS) Order 1982 r/w Section 7(1)a(ii) of the Essential Commodities Act, 1955, in Crime No.30 of 2016 on the file of the respondent police and hence, seeks anticipatory bail.

2. The case of the prosecution is that the accused has illegally transported 325 bags of rice i.e.15,925 kgs. which is meant for public distribution systems.

3. The learned counsel for the petitioner would submit that the petitioner is the owner of the lorry bearing registration No.TN 28 M 3760 and he is an innocent person and has been falsely implicated in this case.

4. The learned Government Advocate (Criminal side) appearing for the respondent would submit that the accused have illegally transported huge quantity of rice.

5. Considering the above facts and circumstances of the case, this Court is of the opinion that the petitioner is not entitled for anticipatory bail. Accordingly, the criminal original petition is dismissed. 14.03.2016 sms
