O R D E R

The Writ Petition is filed challenging the minutes of the Peace Committee Meeting dated 17.08.2024 convened by the 1st respondent.

A reading of the impugned proceedings of the 1st respondent would indicate that there was a dispute between two communities with regard to celebration of temple festival in Kongalamman and Renugadevi Temple situated at Nallagoundapalayam, Pilikkalpalayam Post, Paramathyvelur Taluk, Namakkal District. In the Peace Committee Meeting convened by the 1st respondent dated 17.08.2024 rival parties had participated and a decision was taken to restrict the number of participants to 20 in the Grahapiravesam 3/7

function to be celebrated in the temple. The impugned order also reads that there shall not be any loudspeakers during festival time. Aggrieved by the minutes recorded in the Peace Committee Meeting, the petitioner has come by way of this writ petition.

3. When the writ petition is taken up for hearing, it is admitted by both the parties the Grahapiravesam Function was conducted on 17.08.2024 and 18.08.2024. Since the Peace Committee Meeting was convened for the purpose of conducting a Grahapiravesam Function amicably in the temple in question and the same is already over, nothing survives for further consideration in this writ petition.

However, the learned counsel appearing for the petitioners submitted that Clause-4 of the resolution, which reads that police protection will be given to the function, if concerned officials are informed in advance, would cause trouble in future. The Clause-4 of the minutes only says that in case concerned officials are informed in advance about the conduct of festival in the temple, necessary police protection will be given to the temple function.

5. Therefore, I do not think there is anything in the said resolution which will affect the rights of the parties materially. The effect of resolution is only to give police protection for smooth conduct of temple festival. In view of the admitted position, the function was already over, the prayer sought for in this writ petition has become infructuous.

6. Accordingly, the Writ Petition is dismissed as infructuous. No costs. Consequently, the connected writ miscellaneous petitions are closed. 10.09.2024 Index : Yes/No Speaking order:Yes/No dm 5/7
