in C.S.No.373 of 2021 C.V.KARTHIKEYAN,J., There was already a direction on 06.09.2022, directing the respondents to produce security in the form of documents of title for property worth Rs.50/- lakhs.

2. The said direction has not been complied with.

3. Registry had also put up a note that security has not been furnished till date.

4. In view of that, the consequential order which naturally follows is that the properties which are given in the Schedule to the Judges Summons will have to be attached in manner known to law.

5. In the Judges Summons, Schedule 'A' contains Item Nos,1, 2, 3, 4, 5, 6, 7 and 8. Out of these items, Item Nos.1, 2 and 3 alone are residential properties rather which are definitely not agricultural lands and therefore an order of attachment directed against Item Nos.1, 2 and 3 alone. The other items namely Item Nos.4, 5, 6, 7 and 8 are agricultural lands and it is informed by the learned counsel for the respondents that agricultural activity is going on.

6. Mr.A.Ilayaperumal, learned counsel for the petitioner however stated that the petitioner may also participate in such agricultural activity and can have a share in the properties.

7. I leave it to the wisdom of both the parties in that regard.

8. Schedule 'B' is two cars and two motor bikes.

9. It is stated by the learned counsel for the respondents that they are already a subject matter of hypothecation and therefore, since that particular aspect would have to first adjudicated, they are not subjected to any order of this Court in this application.

10. Recording as above, the application stands partly allowed.

11. It is seen that already a direction has been issued that the properties under the Schedule to the Judges Summons are not be alienated. That direction would continue to hold for Item Nos.4, 5, 6, 7 and 8 of Schedule 'A' till the disposal of the suit.

12. Necessary process to be taken for effecting attachment of Item Nos.1, 2 and 3 properties in Schedule 'A'. Attachment to be effected by 31.12.2022. The fact of such attachment may also be noted in the relevant registers by the jurisdictional Sub Registrar Office. 09.11.2022 ssi 3/4
