Crl.OP.No.24453/2019 Crl.OP.No.24453/2019 A.D.JAGADISH CHANDIRA, J., The learned counsel for the appellant would submit that originally on the complaint filed by the appellant, a case was registered against the respondents/accused for the offence under section 420 and under section 3 and 4 of the Prize Chits Money Circulation Scheme (Banning) Act , 1978.

The trial Court had acquitted the respondents/accused for the offence under Section 420 of IPC, whereas convicted them for the offence under Section 3 and 4 of the Prize Chits Money Circulation Scheme (Banning) Act , 1978.

However, the Appellate Court without considering the evidence both oral and documentary, let in by the prosecution against the accused before the trial court and acquitted them for offence under Sections 3 and 4 of the Prize Chits Money Circulation Scheme (Banning) Act 1978, namely conducting fraudulent chit, the accused / defacto complainant has been cheated to the tune of Rs.13 Lakhs.

In view of the above, leave is granted and the Registry is directed to number the criminal appeal, if papers are otherwise in order.
