O R D E R
The petitioner herein seeks issue of writ of mandamus directing the respondents 4 & 5 to take over the management of Arulmighu Maariamman Thirukkovil at Mottur Colony Village, Kanagamuttu Post, Krishnagiri Taluk, Krishnagiri District as per the proceedings of the 5th respondent in Na.Ka.No. 4758/2023/A1 dated 15.06.2023.
2.According to the petitioner, he is a worshipper of Arulmighu Maariamman Thirukkovil situated at Mottur Colony Village, Kanagamuttu Post, Krishnagiri Taluk, Krishnagiri District and due to dispute between two group of people in the village concerning the Management of the above said 2/6
temple, the poojas of the temple got affected and the temple is kept under lock and key for the past two years. It is submitted by the petitioner that the 2nd respondent recommended to the 5th respondent to take over the Management of the temple. In this regard, the Inspector of HR & CE Department, Krishnagiri District has submitted a report to the 5th respondent after conducting enquiry in the village. The 5th respondent in turn submitted a report to the 4th respondent on 15.06.2023, in his proceedings in Na.Ka.No.4758/2023/A1. Though, the 5th respondent submitted his report regarding taking over of the Management of the temple, the 4th respondent has not considered the same till date. In these circumstances, the petitioner has come up with this writ petition.
3.Mr.P.Anandha Kumar, learned Government Advocate takes notice for the respondents 1 to 3. Mr.K.Karthikeyan, learned Government Advocate (HR & CE) takes notice for the respondents 4 & 5. 4.The learned Government Advocate appearing for the respondents 4 & 5 on instructions, submits that report submitted by the 5th respondent will be considered by the 4th respondent in due course and final orders will be passed. 3/6
5.In view of the fact that the petitioner averred in the affidavit that the poojas of the temple is stopped and the same is kept under lock and key for the past two years, this Court is inclined to issue a direction to the 4th respondent to consider the report of the 5th respondent dated 15.06.2023 and pass final orders on merits and in accordance with law after hearing all the parties interested in the temple within a period of eight weeks from the date of receipt of copy of this order.
6.With the above direction, the writ petition stands disposed of. No costs.
