5.M.Vijay Anand : Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying to issue Writ of Mandamus directing the second respondent to carry out the sub division/amendment in the revenue record by carrying out the sub-division of 41 in Survey field No.1 which is admeasuring to an extent of Ace 1.08 cents situated at Kolapakkam Village, Guduvancherry Firka, Vandalur Taluk, Chengalpattu District based on the enquiry conducted on 09.07.2024 and include the same in the concerned revenue records of the Taluk Office by considering the petitioner's representation dated 07.04.2025 within a time frame fixed by this Court.

ORDER
By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself. In view of the order that this Court proposes to pass and also the limited relief that is sought to be granted, notice to respondent No.5 is dispensed with.
2. The present writ petition is filed praying for a writ of mandamus to direct the second respondent to carry out the sub division/amendment in the revenue record by carrying out sub-division of 41 in Survey field No.1, admeasuring an 2/6
extent of Acre 1.08 cents situated at Kolapakkam Village, Guduvancherry Firka, Vandalur Taluk, Chengalpattu District based on the enquiry conducted on 09.07.2024 and include the same in the concerned revenue records of the Taluk Office by considering petitioners' representation dated 07.04.2025 within a time frame fixed by this Court.

At the outset, it was submitted by the learned Additional Government Pleader for respondents 1 to 4 that earlier petitioners had submitted a representation dated 08.11.2022 seeking to carry out sub division of the subject property. This court in WP No.19337 of 2023, by order dated 30.06.2023 had directed to dispose of the said representation. Pursuant to the said direction, the petitioners submitted two other representations dated 20.01.2024 and 07.04.2025 seeking to carry out sub division/amendment in the revenue record by carrying out the sub-division of the subject property. He would submit that enquiry on the above representations is in progress and Tahasildar has called for a report from the Revenue Inspector. On the receipt of the same, appropriate orders would be passed, within a time frame to be fixed by this Court, which was agreed to by the learned counsel for petitioner.

In view of the limited relief that is prayed, this court is inclined to dispose of the writ petition with following directions: i) The second respondent shall consider the representation dated 07.04.2025 and complete the equiry, after issuing notice and affording a reasonable opportunity of hearing to the petitioners, fifth respondent and all other interested parties including rival claimants, if any.
ii) Though facts have been set out in affidavit, in view of the limited relief that is sought to be granted, I do not propose to examine the same, lest it may influence the authority. The authority shall independently consider the facts and law set out in the representation and pass appropriate order in accordance with law including but not limited to the provisions of the Tamil Nadu Patta Pass Book Act and Rules.
iii) The petitioners' representation dated 07.04.2025 shall be disposed of within a period of twleve (12) weeks from the date of uploading of web copy without waiting for the receipt of certified copy. iv) It is made clear that this Court has not expressed any views with regard to the merits of the case and it is open to the concerned respondent to consider the matter on its own merits and in accordance with law. Rights and contentions of the 4/6
petitioner and all other interested parties are left open.
6. Accordingly, the writ petition stands disposed of. There will be no order as to costs.
