ORDER
The present writ petition has been filed with a prayer for mandamus, to direct the respondent to appoint the petitioner to the suitable post in the light of Section 9(2) of Tamil Nadu Civil Services (Appointment on Compassionate Grounds) Rules, 2023 based on the representation given by the petitioner dated 1/4
29.05.2025 within a stipulated time.
2. The learned counsel for the petitioner submits that the petitioner's father was appointed as a Sweeper during 1999 and passed away while in service on 10.08.2023. It is further submitted that after his demise, the petitioner's brother submitted an application for compassionate appointment, however he subsequently, passed away on 15.07.2024. Thereafter, the petitioner's nephew (the son of her deceased brother) submitted an application for compassionate appointment, which was rejected on the ground that he does not fall within the definition under Section 3(2) of the Tamil Nadu Civil Services (Appointment on Compassionate Grounds) Rules, 2023. Subsequently, the petitioner, being the daughter of the deceased and falling within the scope of the said Rules, submitted an application on 29.05.2025, which is currently pending with the respondent.
3. At this juncture, the learned Standing Counsel appearing on behalf of the respondent submitted that they will consider the petitioner's above representation dated 29.05.2025 and pass orders according to its own merits and in accordance with law within a reasonable time.
4. I have given my anxious consideration to either side submissions and 2/4
also perused the materials available on record.
5. In such view of the fair submission made by the learned Standing Counsel, without going to the merits of the writ petition, this Court deems it appropriate to direct the respondent to consider the petitioner's above representation dated 29.05.2025, according to its own merits and in accordance with law within a period of eight (8) weeks from the date of receipt of a copy of this order.
6. With the above observations, the Writ Petition stands disposed of. No costs.
