Petition filed under Article 226 of the Constitution of India to issue a writ of Certiorarified Mandamus to call for the records pertaining to order dated 14.07.2004 bearing Roc. No.26522/04/K1 of the respondent herein and quash the same in so far it relates to the petitioner and further direct the respondent to restore the original rank assigned to the petitioner in the seniority list of Deputy Block Development Officer published in proceedings bearing Roc.No.26522/04/k1 dated 28.05.2004 of the respondent.

O R D E R

The petitioner is challenging the Order dated 28.05.2004, wherein, the respondent/District Collector issued a temporary Industrial Seniority list of the Deputy Block Development Officer, who was serving as a Deputy Block Development Officer as on 01.03.2004. After drawing the seniority list in the cadre of Deputy Block Development Officer and in the very same impugned Order the District Collector clearly said, if any person aggrieved by this Order may prefer appeal to the Office, through the Head of the Office within 15 days. Hence, the petitioner filed this writ petition challenging the above said order.

2. On perusal of the impugned order dated 28.05.2004, there is an appeal remedy available to the petitioner in the District https://hcservices.ecourts.gov.in/hcservices/

Collector Office itself. Without exhausting the appeal remedy, approaching this Court is not sustainable.

3. Accordingly, the writ petition is dismissed with liberty to the petitioner to approach the respondent/District Collector to exhaust the appeal remedy available in the District Collector's Office. No Costs.
