IN THE HIGH COURT OF JUDICATURE AT MADRAS

( Criminal Jurisdiction ) Wednesday, the Fifth day of January Two Thousand Twenty Two PRESENT The Hon`ble Mrs Justice T.V. THAMILSELVI CRIMINAL ORIGINAL PETITION No.25668 of 2021 ARAVINDHAN [ PETITIONER / ACCUSED ] Vs STATE REPRESENTED BY, [ RESPONDENT ] THE INSPECTOR OF POLICE, J-13, THARAMANI POLICE STATION, CHENNAI (CRIME NO. 492 OF 2021) For Petitioner : M/S.R.PRABHAKARAN Advocate For Respondent : MR.N.S.SUGANTHAN, Government Advocate, (Crl.Side) PETITION FOR BAIL 439 Cr.P.C.

ORDER : The Court Made the following order :- The petitioner who was arrested and remanded to judicial custody for the offences under Sections 341, 294(b), 336, 427, 392, 307 and 506(ii) of IPC, in Crime No.492 of 2021, on the file of the respondent police, seeks bail.

2. The case of the prosecution is that on 29.10.2021 when the de facto complainant was carrying on his business at his Grocery shop, the petitioner and other accused person, due to previous enmity, approached the defacto complainant and assaulted him with knife due to which, the defacto complainant sustained injuries. Further, the accused pelted stones on the public. Hence the complaint. 3.The learned counsel for the petitioner would submit that the petitioner is a college student and he has not committed any offence as alleged by the prosecution and he has been falsely implicated. He would further submit that this is the second application for bail and https://hcservices.ecourts.gov.in/hcservices/

the earlier application was dismissed by this Court in Crl.O.P.No.22975 of 2021 by order dated 01.12.2021. Hence, he would pray for grant of bail.

4.The learned Government Advocate (Crl. Side) would raise strong objection stating that the de facto complainant sustained grievous injuries and took treatment as in patient for several days and he suffered 25 sutures and undergone 3 operations and till date he has been taking treatment as outpatient.

5. Considering the grave nature of offence and that the investigation has not been completed and if the petitioner is released on bail, there is every possibility of the petitioner getting abscond and tampering the evidence. Hence, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
