JUDGMENT

(Judgment of the Court was delivered by J.NISHA BANU, J.) This writ appeal is preferred as against the order of the learned Single Judge dated 30.06.2025 made in W.P.No.23471 of 2025.

2. The writ petitioner is the appellant herein. The case of the appellant/ writ petitioner is that she is the joint owner of the properties comprised in S.Nos.1474/Part, Sriperumbudur Village, Sriperumbudu Taluk, Kancheepuram District, measuring total extent of 4 Acres 90 cents. Originally these properties are the ancestral property of the petitioner's grandfather Mr.Govindhasamy Reddy. After his demise, her father Mr.G.Keesavaramanujam and his son Mr.Govardhan and daughters, namely the appellant / L.Subashini and Mrs.Banumathy were enjoying the same without any hindrance. While that being so, without having any iota of right, her father has sold the aforesaid properties in favour of the Governor of Tamil Nadu, vide registered sale deeds in Doc.No.5065 of 2000 dated 25.10.2000, (ii) Doc.No.291 of 2001 dated 29.12.2022 and (iii) Doc.No.292 of 2001 dated 29.12.2000. The writ petitioner came to know about the said sale made by her father only during the month of June 2024. According to

the petitioner/appellant, the disputed properties being ancestral properties, her father has no right to sell the same without the knowledge of the petitioner and her sisters. With regard to the alleged sale deeds, the petitioner/appellant submitted a representation dated 22.10.2024 to the respondents for payment of proper compensation and since no action was taken, she was constrained to file the aforesaid writ petition. The learned Single Judge has disposed of the writ petition by observing that the only option is either to reconvey the property or question the same before the competent Civil Court. Being aggrieved by the said order, the writ petitioner/appellant is before this Court with the instant writ appeal.

3. Heard the learned counsel for the parties and perused the entire materials available on record.

4. The grievance of the appellant is that her father had sold the property, which are now worth around Rs.75 Crores, by way of alleged sale deeds without the knowledge the appellant or his sister. If at all the appellant alleges that her father did not have any right to convey the properties, since the disputes revolve around the property, the appellant can seek her remedy

only before the Civil Court and in civil disputes, the Writ Court cannot give any positive direction to the respondents to act on the petitioner /appellant representation. The learned Single Judge has rightly observed that once the sale deed is executed and title passed on to the department, the question of cancellation of the sale deeds does not arise and the only option is to approach the competent Civil Court. This Court is in complete agreement with the view taken by the learned Single Judge and finds no infirmity in the order of the Writ Court.
