C.M.P.No.19709 of 2022 in C.M.A.SR.No.109991 of 2022 SUNDER MOHAN,J.

This Petition has been filed seeking to condone the delay of 50 days in filing the above Civil Miscellaneous Appeal.

2. Though the notice to the sole respondent has been returned for the reason "unclaimed", this Court vide order dated 11.09.2023 directed the learned counsel for the petitioner to serve a copy of notice on the counsel, who had appeared for the sole respondent before the Trial Court.

3. It is seen that the learned counsel had served the copy and the name is printed in the cause list. However, none appeared on behalf of the sole respondent.

4. Heard the learned counsel for the petitioner/appellant.

5. Considering the averments made in the affidavit filed in support of this petition and being satisfied with the same, the delay is condoned. Hence, this petition is ordered as prayed for.

6. Registry is directed to number the C.M.A., if it is otherwise in order and list the same in due course.
