Respondent Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of mandamus directing the respondent to consider and pass orders on the representation dated 02.09.2016 by the petitioner seeking to approve the Managing Committee of Jamia Masjid Trust Board.

ORDER

Heard the learned counsel for the petitioner and Mr.Mohamed Fayaz Ali, learned counsel accepting notice on behalf of the respondent and with the consent on either side, the writ petition is taken up for final disposal.

The petitioner would state that Jamia Masjid Trust Board manages Jamia Masjid and Fisthar Ali Shah Makkan and Muslim burial ground wakf and elections in respect of the above said Wakf was conducted on 19.11.2015 and the respondent / Wakf Board also sent a notices to the Superintendent, Salem Wakf and to the Muthavalli, Jamia Masjid, Salem, intimating them about the Meeting to be convened on 02.03.2016 at 3.00 p.m. for approving the appointment of the newly elected members and to be present along with all the relevant documents. Since the same was not done, the petitioner, who is the Muthavalli of Jamia Masjid Trust Board, Salem, has sent a representation dated 02.09.2016 to the respondent seeking for necessary action. Since the petitioner is to be favoured with any kind of response, he is before this Court with the present writ petition.

Taking into consideration, the limited scope of prayer sought for by the petitioner, this Court, in the light of the above facts and circumstances and without going into the merits of the claim projected by the petitioner either in his representation or in the writ petition, directs the respondent to consider and dispose of the petitioner's representation dated 02.09.2016 on merits and in accordance with law and pass orders within a period of four weeks from the date of receipt of a copy of this order and communicate the decision taken, to the petitioner. The writ petition is disposed of with the above direction. No costs.
