Though the petitioners have come up with this Miscellaneous petition seeking to accept the cause title by bringing the 4th respondent who is the brother of the deceased in the place of the mother of the deceased, who was arrayed as 4th claimant before the trial court, the same cannot be permitted for the reason that the brother was not arrayed as a claimant before the tribunal and therefore, at the appellate stage, merely because the mother of the deceased who was arrayed as the 4th claimant has since deceased cannot be a ground to bring the brother of the deceased as the 4th respondent in the appeal.
2. Therefore, this Miscellaneous petition seeking to accept the cause title is dismissed.
3. Registry is directed to number the appeal if it is otherwise in order and list the matter for admission.
