Crl.M.P.No.13189 of 2019 in Crl.O.P.No.27938 of 2018 Crl.M.P.No.13189 of 2019 in Crl.O.P.No.27938 of 2018 M.NIRMAL KUMAR., J This Criminal Miscellaneous Petition has been filed seeking for extension of time for a period of six months to complete preliminary enquiry as directed by this Court by an order dated 12.12.2018 in Crl.O.P.No.27938 of 2018. 2.According to the learned counsel for the petitioner, the approval permission for preliminary enquiry was on 25.08.2019, thereafter, enquiry was conducted on 29.05.2019 in PE 29/2019/PUB/SIC. Since the preliminary documents in this case is to be obtained from the Income Tax Authorities and a communication has been sent to the Income Tax Authorities on 26.06.2019 and yet to receive the documents from them.

It is also submitted that the officers from the petitioner department have called upon the Income Tax authorities on five occasions and it was reported to them that the Income Tax authorities have sent communication, seeking permission to part with the documents. Once the permission is obtained, it is learnt that they would immediately furnish the documents required by the petitioner. On receipt of the same, the investigation on that line will be carried out and further with the available materials the preliminary enquiry is in progress.
