B.Indirani v. N.Mani
C.M.P.No.4735 of 2023 in S.A.No.160 of 2023 N.SESHASAYEE, J.
The appellant / plaintiff has taken out this application for an order of injunction to protect the possession vis-a-vis 'B' schedule property in this suit. This Court is at a loss to understand as to why the appellant should seek an order of injunction when the first appellate Court has granted a decree in favour of the appellant, protecting her possession over 'B' schedule property. 2.Learned counsel for the appellant, however informs the Court that notwithstanding the decree granted by the first appellate Court, the respondent has preferred a complaint against the plaintiff, based on which F.I.R came to be registered against the plaintiff and her son. The appellant will be at liberty to take such appropriate legal measures for protecting her from prosecution in criminal cases. But so far as this petition is concerned, since the appellant has a decree in her favour to protect her possession, the Court cannot grant an interim injunction.
3.This petition stands closed accordingly.
