ORDER

This Criminal Original Petition has been filed by the petitioner to direct the third respondent herein not to harass the petitioner in any manner except by due process of law pursuant to the representation dated 13.11.2021 given to the respondents.

2. Grievance of the petitioner is that the petitioner being unnecessarily disturbed by the third respondent police without any recent case as against him. The petitioner had been showing good conduct and living peacefully for the past two years.

3. Learned Additional Public Prosecutor appearing for the respondents would submit that the petitioner is a history sheeter. Three previous cases are pending as against the petitioner. One of case is for the offence punishable under section 302 I.P.C. Only for the purpose of tracing the movement of the petitioner, details of the petitioner is called for, which cannot be termed as harassment.

4. Having three cases pending against the petitioner, calling the details of the accused would not meant to harassment. Hence, the Criminal Original Petition is dismissed. Sd/- Assistant Registrar(CCC) //True Copy// Sub Assistant Registrar mfa To 1.
