(This case has been heard through Video conference) Learned counsel appearing for the petitioner/complainant would submit that the Trial Court, finding that the petitioner has proved the case has convicted the accused, however, on appeal, the Appellate Court, wrongly interpreted Ex.P7/Legal Notice and by rendering a wrong finding that the notice was defective, allowed the Appeal and acquitted the accused. He would further submit that there is specific mention about the cheque in the notice and the petitioner had demanded the accused to repay the money, whereas, the Appellate Court had rendered a wrong finding.

2. Having heard the counsel and perused the materials available on record, this Court is of the opinion that a prima facie case is made out for grant of leave.
