ORDER

This writ petition has been filed challenging the order of the respondent dated 22.09.2016 passed on the representation of the petitioner dated 20.09.2016 refusing to accord permission for the conduct of cultural program in connection with the festival to be held on 19.10.2016 at Arulmighu Nithiya Sumangali Mariamman Thirukoil at Thattankuttai in Rasipuram Taluk and to direct the respondent to accord necessary permission and police protection for the conduct of cultural program during temple festival.

2. It is seen that the petitioner made a representation dated 20.09.2016 to the respondent police seeking permission for the conduct of cultural program in connection with festival of Arulmighu Nithiya Sumangali Mariamman Thirukoil and the same was https://hcservices.ecourts.gov.in/hcservices/

rejected by the respondent on 22.09.2016.

3. The learned counsel for the petitioner submitted that if the petitioner is permitted to conduct cultural program with a direction to wind up before 10 p.m. on 19.10.2016 it would suffice.

4. The learned Additional Public Prosecutor submitted that no obscene dance program should be allowed to be performed in the name of cultural program.

5. Taking into consideration of rival submission, the petitioner is directed to give a fresh representation to the respondent for the conduct of cultural program agreeing to the conditions to be specified by the 2nd respondent and that the program shall be wound up by 10.00 p.m. on 19.10.2016. On such representation being made, the same may be considered taking into consideration the law and order situation in the area.

6. In the result, the writ petition is disposed of with the above directions. No costs.
