This petition has been filed to implead the State Bank of India, Centralised Pension Processing Centre (Code No.4470), No.112/4, Kaliamman Koil Street, Virugambakkam, Chennai 600 092 as respondent No.3 in the writ petition.

2. According to the petitioners/BSNL, though the Department has fixed the pension of the first respondent correctly by applying 35.1% of the Industrial Dearness Allowance, the State Bank of India, has erroneously disbursed the pension at the higher rate, by applying 78% of DA. In such circumstances, the State Bank of India was not a party to the original proceedings, however, in the interest of justice, it is just and necessary to implead them as a party/respondent No.3 in the present writ petition for effective adjudication of the dispute by this Court.

3. Heard the learned counsel for the petitioners and the learned counsel for the first respondent.

4. Being satisfied with the reasons assigned in the affidavit filed along the petition, we are inclined to allow the petition.

5. Accordingly, this petition is allowed.
