Respondents Petition filed under Article 226 of the Constitution of India praying for issue of Writ of Mandamus to direct the respondents to cancel the alleged patta issued in Survey No.2443/B which is earmarked for common purpose in the patta dated 09.08.2001 in Survey No.246, 247 and 244, situated at Navakkurichi village, Attur Taluk, Salem District and restore the land earmarked for common purpose to remain as same in its original status based on the petitioner's representation dated 13.07.2016.

O R D E R

(Order of the Court was made by The Hon'ble Chief Justice) The petitioner claims that pattas are allotted for the benefit of the Scheduled Caste people under free housing site scheme in the land in S.Nos.246, 247 and 244 situated in Navakkurichi village, Attur Taluk, Salem District. It is the case of the petitioner that the pattas are dated 09.08.2001 and at that time, certain land was earmarked for common purposes. But subsequently, that land is sought to be allotted as housing sites. The representation dated 13.07.2016 made by the petitioner has remained unattended.

2. The learned Additional Government Pleader submits that the complaint of the petitioner would be examined, keeping in mind that the civil suit is still stated to be pending.

3. We thus direct respondent No.1/District Collector to look into the representation of the petitioner referred to aforesaid, after notice to all concerned within a maximum period of three months of the receipt of copy of this order, of course keeping in mind the civil disputes stated to be pending and its scope.
