PRAYER: Criminal Original Petition has been filed under Section 482 of the Code of Criminal Procedure to direct the respondent police not to harass the petitioner in the name of investigation. For Petitioner :

ORDER

This criminal original petition has been filed to direct the respondent police not to harass the petitioner in the name of investigation.

2.The grievance of the petitioner is that in a partnership business, there was some dispute between the partners, for which, a complaint has been lodged by one Dhayalan. The petitioner had appeared for enquiry before the respondent police on 13.11.2021. Thereafter, he was asked further to appear on 18.12.2021. Despite the petitioner giving his explanation, the petitioner was ignored and finding that it is an harassment, he had not appeared on 18.12.2021. Thereafter, now again the petitioner is pressurized and harassed to appear for enquiry on 25.12.2021.

3.The learned Additional Public Prosecutor submits that one Sivakumar lodged a complaint against the petitioner to the Superintendent of Police, which was received by the respondent police in C.No.262 of 2021. The petitioner and the said Sivakumar appeared on 13.11.2021, thereafter, the petitioner failed to appear. The complainant Sivakumar appeared on 18.12.2021 and again the petitioner was called for enquiry on https://hcservices.ecourts.gov.in/hcservices/

25.12.2021 to give his explanation along with the documents. 4.Finding that there is some dispute between the petitioner and his erstwhile partner, for which, the petitioner to appear before the respondent police on 25.12.2021 along with the documents and other materials available with him to substantiate his case. Thereafter, the respondent police to conclude the enquiry within a period of two weeks from the date of receipt of a copy of this order.

5.With the above directions, this Criminal Original Petition is disposed of.
