For Petitioner : Mr.Kandhan Duraisami For R1 : Mr.A.Mohamed Gouse For R2 and R3 : Mr.K.Tippu Sulthan Government Advocate O RDER This Writ Petition has been filed challenging the order passed by the first respondent dated 05.12.2024, thereby rejecting the request for permission to start Master of Physiotherapy course in the petitioner institution and issue registration of starting Master of Physiotherapy Course in Sree Abirami College of Physiotherapy, Machegoundanpalayam, Seerapalayam village, Eachanari, Madukkrai Taluk, Coimbatore - 641 021.
2. Heard the learned counsel on either side and perused the materials available on record.
3. The petitioner was granted permission to start Bachelor of Physiotherapy course on 02.08.2018 by way of G.O.Ms.No.324, Health and Family Welfare (PME-2) Department dated 02.08.2018 with an annual intake of
50 seats. The petitioner institution was also duly registered with the first respondent and granted affiliation. As per the statute for Master of Physiotherapy dated 24.08.2012, issued by the first respondent, it prescribes the procedure to apply for certificate of registration of application seeking provisional affiliation for starting Master of Physiotherapy degree.
4. Accordingly, the Colleges which were conducting Bachelor of Physiotherapy course of the Tamil Nadu Dr.M.G.R.Medical University only are eligible to apply for Master of Physiotherapy degree course. Further the Certificate of Registration shall be in writing and in the prescribed Form No.I. Further, Statute No.50 also says to comply with other conditions. After fullfilling all the conditions prescribed for applying for Certificate of Registration from the first respondent, the petitioner can seek provisional affiliation for starting Master of Physiotherapy course for its institution viz., Sree Abirami College of Physiotherapy, Machegoundanpalayam, Seerapalayam village, Eachanari, Madukkrai Taluk, Coimbatore - 641 021.
5. However, it was rejected on the ground that there is an embargo by the National Commission and further sought for No Objection Certificate. This
issue was already dealt with by this Court in a batch of writ petitions in W.P.No.28894 of 2025 and batch dated 16.09.2025.
6. Insofar as the issue of getting No Objection Certificate from the State Government is no longer res-integra. The Hon'ble Division Bench of this Court in W.A.No.3534 of 2019 dated 16.06.2020, dealt with the same issue and directed to consider the applications for granting permission to start Post Graduate course. The said order was also confirmed by the Hon'ble Supreme Court of India in SLP.(C) No.16085 of 2020 dated 12.01.2021.
7. In view of the above, the petitioner is directed to re-submit the application, within a period of two weeks from the date of receipt of a copy of this order. On receipt of the same, the respondents are directed to consider the application for granting permission to start the Master of Physiotherapy course in the petitioner institution and issue Certificate of Registration for starting Master of Physiotherapy course in the petitioner College, within a period of four weeks thereafter.
8. With the above directions, this writ petition stands disposed of. Consequently, connected Miscellaneous petition is closed. No costs.
