ORDER

The Criminal Revision has been filed by the petitioner/A4, seeking to set aside the order dated 21.08.2019 made in Crl.M.P.No.3327 of 2019 in CC.No.149 of 2017 passed by the learned Judicial Magistrate No.IV, Vellore, Vellore District, dismissing the petition seeking for discharge. Heard both sides.

The learned counsel appearing for the petitioner would submit that he is not pressing this revision. However, he would pray that a direction may be issued to the learned Judicial Magistrate to permit the petitioner to file a petition under Section 243 of Cr.P.C., to examine the witness or defence and that a direction may be issued to the learned Trial Judge to complete the Trial within a fixed time.

The learned Additional Public Prosecutor would submit that there are 10 witnesses in this case and it would be possible for the trial to be completed within six months. https://hcservices.ecourts.gov.in/hcservices/

This Court is of the opinion that the petitioner has got a right under Section 243 of Cr.P.C., to let in evidence on the side of the defence if it is necessary.

Accordingly, this Criminal Revision is disposed of with direction to complete the trial as expeditiously as possible preferably within a period of six months from the date of receipt of a copy of this order. Consequently, connected miscellaneous petitions are also closed.
