The petitioner/A5 seeks bail in C.C.No.139 of 2023 pending before the Principal Sessions Court under EC and NDPS Act cases, Chennai. 2.Crime No.190 of 2022 had been registered under Sections 9A, 22(c) and 25A of NDPS Act, which obviously means that the contraband seized is commercial quantity. There was a two wheeler which was pointed out by the respondent and there was a bag and inside that two other bags containing Methamphetamine and Ephedrine each weighing one kilo grams was found. The petitioner was standing next to the two wheeler and he had also been identified.

3.The learned counsel for the petitioner stated that the other accused have been granted bail consequent to final report not having been filed within the statutory period.

4.But, however, this is third application for bail filed by the petitioner and the earlier application was dismissed by the learned Single Judge of this court on 16.08.2023. Even then, it had been observed that the twin conditions required under Section 37 of NDPS Act had not been satisfied by the petitioner.

5.Let there be further progress in the trial and thereafter, the petitioner has come back to this Court seeking bail. https://www.mhc.tn.gov.in/judis 1/2
