Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to permit the petitioner/3rd Respondent to continue with the Disciplinary proceedings initiated against the 1st Respondent/Petitioner.
Order : This Miscellaneous petition coming on this day for hearing upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of MR.R.THIRUNAVUKKARASU, Advocate for the petitioner and of MR.N.NAGANATHAN, Advocate for the 1st Respondent and of MR.K.V.SAJEEV KUMAR, Special Government Pleader for the 2nd Respondent, the court made the following order:- The 3rd respondent in W.P.No.18376 of 2021 has come up with this writ miscellaneous petition, seeking permission to continue with the disciplinary proceedings initiated against the writ petitioner.

2.For better understanding parties herein are referred to as per their ranking in the main writ petition.
3.The community certificate issued in favour of the petitioner was cancelled by the State Level Scrutiny Committee. Questioning the same, the present writ petition has been filed and an interim stay has been granted in favour of the petitioner. 4.The learned counsel appearing for the 3rd respondent - Central Warehousing Corporation would submit that the employer of the writ petitioner be permitted to conduct disciplinary proceedings already initiated against the petitioner and the conclusion shall be kept in abeyance, till the writ petition reaches its finality.
5.The learned counsel for the petitioner would state that the petitioner will be retiring from service on 31.12.2021 and the departmental proceedings have been initiated after filing of this writ petition.
6.Considering the fact that the community certificate issued in favour of the petitioner was canceled by the State Level Scrutiny Committee, the 3rd respondent is permitted to continue the disciplinary proceedings, however, final decision shall be taken after disposal of the writ petition.
