Respondents PRAYER: This Writ Petition has been filed under Article 226 of the constitution, to issue Writ of Mandamus, to direct the respondent 1 and 2 to delete my name from the history sheet rowdy list in H.S.No.419 of 2016 pending on the file of the 3rd respondent, based on my representation dated 30.11.2021 within the time framed by this Hon'ble court.

ORDER

The petitioner, who has been listed as history sheeter in H.S.No.419 of 2016 had sent a representation dated 30.11.2021 to the respondents to remove his name from the history sheet. His representation was received on 03.12.2021, but, so far no action has been taken.

2. The contention of the petitioner is that totally, four cases were registered as against the petitioner, of which, a case in Crime No.281 of 2008 ended in acquittal. Thereafter, in the year 2017, the petitioner was implicated in another case in S.C.No.305 of 2017 followed it by other case in Special S.C.No.14 of 2019. The petitioner further submits that keeping the petitioner's name pending in the History https://hcservices.ecourts.gov.in/hcservices/

Sheet, the petitioner is implicated in one case or the other, further 110 Cr.P.C proceedings are initiated against him. In view of the same, the petitioner had sent a representation.

3. The learned Additional Public Prosecutor submitted that the petitioner is a History Sheeter in H.S.No.419 of 2016. The petitioner had involved in 4 cases, of which, one case in Crime No.281 of 2008, he got acquittal, one case in Crime No.114 of 2014, is pending trial, one case in Crime No.269 of 2016 is under investigation and one case in S.No.14 of 2021 is not taken on file.

4. In view of the petitioner's antecedents, the petitioner's name is retained in the History Sheet. The Superintendent of Police, Cuddalore, considering the representation of the petitioner and also the objections of the Inspector of Police, Annamalai Nagar Police Station, to pass appropriate orders on the representation of the petitioner dated 30.11.2021, within a period of 4 weeks from the date of receipt of the copy of the order.

5. In view of the same, this Writ Petition is disposed of. No costs.
