[Judgment of this Court was delivered by T.RAJA, J.] When the matter is taken up for hearing, it is submitted by the learned Special Government Pleader appearing for the second respondent that the first respondent died.

2.There is no appearance for the appellant. Although the matter was of the year 2004, neither the appellant nor their counsel appeared before this Court to prosecute the matter. Therefore, we are of the view that this appeal could be dismissed for non prosecution. Accordingly, this appeal stands dismissed. No costs.
