PETITION under Article 226 of The Constitution of India praying for the issuance of a Writ of Mandamus directing the respondents to consider the petitioner's representations dated 14.6.2019 and 27.3.2023 within the time stipulated by this Court. For Petitioner :

ORDER

This writ petition has been filed seeking a direction to the respondents to consider the petitioner's representations for appointment on compassionate grounds.

2. Heard the learned counsel for the petitioner and the learned Standing Counsel appearing for the respondents.

3. The case of the petitioner is that his father was working as a Senior Attendant, Central Library, IIT, Chennai Campus. He died in harness on 24.6.2006 leaving behind the petitioner - son, his mother - wife and his three sisters - daughters as legal heirs. The mother of the petitioner died on 29.2.2008. At the time of death of his father, the petitioner was aged about 19 years and he was pursuing the course namely diploma in mechanical engineering. The petitioner also made a representation dated 22.12.2018 to the respondents seeking for appointment on compassionate grounds. Even thereafter, the petitioner made several representations to the respondents in this regard, the last of which is dated 27.3.2023. However, he did not get any reply so far. It is under these circumstances the above writ petition has been filed.

Considering the limited nature of the prayer sought for, taking into consideration the facts and circumstances of this case and without going into the merits of the case, there shall be a direction to the first respondent to consider the representation of the petitioner dated 27.3.2023 on its own merits and in accordance with law and convey the final decision to the petitioner within a period of six weeks from the date of receipt of a copy of this order. The petitioner is directed to make a fresh representation to the first respondent with copies of all the relevant documents along with a copy of this order.

5. With the above directions, the writ petition is disposed of. No costs.
