Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to grant an order of mandatory injunction forbearing the 1st Respondent to keep one post of assistant vacant pending disposal of the present writ petition W.P.No.490 of 2017 (W.M.P.No.525 of 2017) Order : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/S.MOHAMMED FAYAZ ALI, Advocate for the petitioner and Mr.KARTHICK SESHAYI on behalf of the Respondents M/S Iyer & Thomas for RR1 and RR2, Mr.AKHIL AKBAR ALI,Government Advocate for Respondents RR3 and RR4, the court made the following order:- The prayer sought for in the present Miscellaneous Petition is to grant an order of mandatory injunction forbearing the 1st respondent https://hcservices.ecourts.gov.in/hcservices/
to keep one post of Assistant vacant, pending disposal of the present writ petition.
It is seen from the records that this Court by order dated 09.01.2017 had dismissed the Interim Stay Petition filed by the petitioner in WMP. No.526 of 2017 and observed as follows; "Since the request made by the petitioner for promotion to the post of Assistant came to be rejected, no stay can be granted in this petition. Hence this petition is dismissed."
In view of the above observation made by this Court, the present Miscellaneous Petition is closed.
