ORDER

This application is filed by the applicant / plaintiff to withdraw and transfer the suit in O.S.No.274 of 2010 pending on the file of learned I Additional Judge, Coimbatore to this Court to be tried along with C.S.No.336 of 2020.

2. It is submitted by the learned counsel on either side that the present suit properties in C.S.No.336 of 2020 are covered in the suit in O.S.No.274 of 2010 pending on the file of the learned I Additional Judge, Coimbatore as Item No.19, hence this application has been filed. 2/4

In view of the above, the suit pending before the learned I Additional Judge, Coimbatore in O.S.No.274 of 2010 can be withdrawn by the applicant/ plaintiff, as the present suit in C.S.No.336 of 2020 is a comprehensive suit for all the properties, without prejudice to the rights of the plaintiff in the suit.
