Criminal Original Petition filed under Section 482 Cr.P.C. to direct the fifth and sixth respondents herein to register the case against the culprits based upon the petitioner's complaint dated 20.10.2015 and file a final report. O R D E R
This petition has been filed to direct the fifth and sixth respondents herein to register the case against the one Ashok, Mangalam, S.Manivannan, M.Kantha, V.Vijayalakshmi, S.Latha and M.Kannan for the alleged offence under sections 420, 465, 467, 468, 441, 341, 506(ii) r/w 120(b) IPC based upon the petitioner's complaint dated 20.10.2015 and to file a final report. Since no action has been taken so far, on the complaint given by the petitioner, the present petition has been filed.
2. When the matter is taken up for consideration, learned Additional Public Prosecutor submitted that on the same set of allegation, earlier, this petitioner lodged a complaint with the Inspector of Police, Ambattur Police Station and he has also filed Criminal Original Petition before this Court Crl.O.P.No.14786/2015 to register the complaint and this Court, by order dated 10.08.2015, has dismissed the said petition as the complaint has been closed after conducting enquiry. Since the complaint was already closed after enquiry, now, on the same set of allegation, the present petition has been filed.
3. Considering the facts and circumstances of the case and considering the fact that the complaint given by the petitioner on the same set of allegation has been closed, now, this Court cannot give a direction in this regard. Hence, the present petition is liable to be dismissed. Accordingly, the criminal original petition is dismissed.
