The petitioners who are arrayed as A2 to A4, apprehend arrest at the hands of the respondent police for the alleged offence punishable under Section 306 IPC in Crime No.41 of 2016 on the file of the respondent police and hence, seek anticipatory bail.
2.The case of the prosecution is that the deceased viz., Bhuvaneshwari had borrowed Rs.30,000/- from the first accused and repaid more than Rs.1,20,000/- towards principal and interest. Despite the same, the first accused was demanding Rs.2,00,000/- from the deceased. For non-payment of the amount, the petitioners along with A1 had trespassed into the house of the deceased and threatened her, due to which, on 08.02.2016 at about 07.00 a.m., the deceased committed suicide by self immolation. 3.The learned counsel appearing for the petitioners submitted that the petitioners are innocent persons and they have been falsely implicated in this case. 4.The learned Government Advocate (crl.
side) submitted that considering the allegations made against the petitioners, earlier anticipatory bail petition filed by the petitioners was dismissed by this Court on 17.02.2016 in Crl.O.P.No.3144 of 20165 and there is no change in circumstances in this case. 5.Considering the nature of the allegation in this case and also taking note of the fact that there is no change in circumstances, after the dismissal of the earlier petition on 17.02.2016, this Court is not inclined to grant anticipatory bail to the petitioners. Accordingly, this Criminal Original Petition is dismissed. 22.03.
