ORDER

The writ petition is filed seeking writ of mandamus to direct the 3rd respondent herein to conduct an enquiry as per the communication O.M. No A3 / 1308 / 2023 dated 18.04.2023 of the 2nd Respondent and to further direct the respondents 1 and 3 not to assign the land and issue Patta comprised in Survey No 185 / 1 in Mukunthanallur village, Thoravalur Post, Vridhachalam taluk Cuddalore District to third parties and keep the same as pathway / road to reach the petitioner lands comprised in Survey Nos. 65/3, 65/4, 65/6, 65/9 and 65/10 situated at Mukunthanallur Village, Thoravalur post, Vridhachalam Taluk, Cuddalore District and pass such further or other orders. 2.

The learned Counsel for the petitioner would submit that the subject land comprised in Survey No.185/1 is being used as road for carrying on agricultural activities in the lands comprised in Survey Nos. 65/3, 65/4, 65/6, 65/9 and 65/10, situated at Mukunthanallur Village, Thoravalur post, Vridhachalam Taluk, Cuddalore. While so, respondents 1 and 3 are in the process of issuing pattas to third parties for the lands comprised in Survey No.185/1. Aggrieved by the same, the petitioners have submitted a representation to respondents 1 and 3 dated 11.04.2023. In response thereto, the

2nd respondent sent a communication dated 18.04.2023 to the 3rd respondent to conduct an inspection of the subject land and submit a report. However, no action has been taken till date. Hence the petition. 3.

The learned Government Advocate appearing for respondents would submit that the representation dated 11.04.2023, would be considered within a time frame that may be stipulated by this Court, which was agreed to by the learned Counsel for the petitioner.

Considering the limited relief sought by the learned counsel for the petitioner, this Court without expressing any opinion on the merits of the case, directs the 3rd respondent to dispose of the petitioner's representation dated 11.04.2023, on merits and in accordance with law, within a period of twelve

(12) weeks from the date of receipt of a copy of this order. With the aforesaid direction, this writ petition stands disposed of. No costs.
