M.K.Kalai Selvam v. V.Malar Kodi (Deceased)

A Nos.6211, 6212 and 6213 of 2024 in T.O.S No.38 of 2011 A.A.NAKKIRAN, J.

These three applications have been filed by the applicants/plaintiffs, i) to condone the delay of 690 days in filing the application to set aside the abatement caused due to the death of the 2nd plaintiff viz., M.K.Muthamil Selvam ii) to set aside the abatement caused due to the death of the 2nd plaintiff and iii) to bring on record the respondents 8 to 10 viz., 1.M.Rajakumar, 2.M.Murali and 3.M.Priya as plaintiffs 8, 9 and 10, who are the legal representatives of the deceased 2nd plaintiff, in the above suit.

2. The learned counsel for the respondents/defendants has no objection in allowing these three applications.

3. Having satisfied with the reasons stated in the affidavits filed in support of the applications, these three applications are allowed.

4. Learned counsel for the plaintiffs is directed to carry out necessary amendment.
