O R D E R

The petitioner has filed this Writ Petition seeking for an issuance of a Writ of Mandamus directing the respondents to pass orders granting appointment to the petitioner on compassionate grounds to any suitable post based on his qualification.

According to the petitioner, the petitioner's father, namely, Devarajan was working under the control of the 3rd respondent, as a Village Administrative Officer in Vengadathampatti Village for several years and passed away on 26.07.2013, leaving behind his mother, wife, two sons and one daughter as legal heirs. The petitioner, who is the 2nd son and 3rd child of the deceased has submitted an application seeking appointment on compassionate ground within a period of three years from the date of death of deceased and at that point of time, the petitioner is a major, since the said application has not been considered, the petitioner has come up with the present petition.

The learned counsel for the petitioner submits that just in order to keep the family away from the poverty caused suddenly due to the death of petitioner's father, the petitioner has submitted a petition requesting the respondents to grant any job under compassionate ground, however, the same has not been done. On the contrary, the learned Government Advocate appearing for the respondents submits that the petitioner's mother is working as a teacher in a Government School and the petitioner's brother is also working in a Health Department in Government, hence the petitioner's prayer for compassionate appointment cannot be granted.

5. Heard the learned counsel appearing on either side and perused the documents placed on record.

6. On going through the documents placed on record, it is seen that the petitioner's father died on 26.07.2013 and the petitioner's mother, one Kalaiselvi has sent a representation seeking compassionate appointment for the petitioner and on enquiry it is found that the petitioner's mother, viz., deceased wife, is working as Teacher in Government Panchayat Union Primary School and the petitioner's brother is working in Health Department as Sanitary Inspector.

7. Considering the above said facts and circumstances of the case, it is seen that the petitioner's family is not in indigent circumstances to grant compassionate appointment and hence this Writ Petition deserves to be dismissed.
