M/S Indusind Bank Ltd v. Suresh R Rengaraj Alias R Suresh
THE HIGH COURT OF JUDICATURE AT MADRAS DATED: 10.03.2025
CORAM:
THE HON'BLE MR. JUSTICE ABDUL QUDDHOSE M/s.IndusInd Bank Ltd., Rep. by its Assistant Vice President, A. Ganesh Kumar Applicant Vs Suresh R. Rengaraj alias R. Suresh Respondent For Applicant :
Ms. Meera Gnanasekar - - - - - As seen from the earlier proceedings, the learned counsel for the applicant has been repeatedly seeking time for the Advocate Commissioner to execute the Warrant of Commission on account of the fact that the vehicle could not be located. Even today, a similar request is sought for. However, this Court is not inclined to grant any further extension. Accordingly this application is disposed of by granting liberty to the applicant to file a fresh application seeking for appointment of an Advocate Commissioner once the vehicle is located. While considering the fresh application, this Court will consider appointing the very same 1/3
Advocate Commissioner, who was appointed earlier by this Court in this application. This Court shall also consider adjusting the initial remuneration paid to the Advocate Commissioner in this application, while considering the payment of remuneration to the Advocate Commissioner, when this Court decides the fresh application. 10.03.2025 vsi2 2/3
