ORDER
The petitioner has come forward with this petition seeking a direction to the second respondent police to register a case based on the complaint of the petitioner dated 03.09.2015. 2.The learned counsel for the petitioner submitted that though the petitioner has lodged a complaint as early as on 03.09.2015, the respondent police has not shown any interest to enquire the matter and register the case. Hence, the petitioner has come forward with this petition for the above stated relief. 3.At this juncture, the learned Additional Public Prosecutor, on instructions, would submit that on receipt of the complaint given by the petitioner, the ADSP conducted enquiry and closed the complaint stating that there was money https://hcservices.ecourts.gov.in/hcservices/
transaction between the petitioner and the proposed accused and since he has not repaid the amount with a view to escape from that, he himself given complaint stating that he is assaulted by the proposed accused with wooden logs but he has not produced any document. Hence, on that basis the complaint was closed and he prayed for dismissal of the petition.
4.Considering the rival submissions made on both sides and on perusal of the typed set of papers and the file produced by the learned Additional Public Prosecutor, this Court is inclined to dismiss this petition as devoid of merits. Hence, recording the submissions of the learned Additional Public Prosecutor, this Criminal Original Petition is dismissed.
